General Terms of Sale 2025 - LLB Auction
Preamble
These General Terms of Sale (hereinafter the "GTS") are intended to govern the contractual relationships that may arise on the occasion of product sales carried out on the www.llb-auction.com website (hereinafter the "Site") or on the occasion of public auctions (hereinafter the "Auctions" or the "Sale") and are applicable to bidders (hereinafter the "Bidders") and buyers (hereinafter the "Buyers"). In these GTS, "we", "our" and "ours" refer to LLB AUCTION Srl-s and "you", "your" and "yours" refer to Bidders and Buyers.
For the purposes of these General Terms of Sale, the Buyer and the Seller are individually or collectively designated as the "Party" or the "Parties".
Our relationships and those of the Seller with Buyers and Bidders concerning the lots offered in the context of a Sale are governed by these General Terms of Sale and the express declarations, warranties and indemnifications given by the Seller. Except in the case where we own a Lot in whole or in part, we act only as agent of the Seller. A sales contract is concluded directly between the Seller and the Buyer. In certain cases, LLB AUCTION may directly own a lot, in which case we will act as Seller.
By registering for a Sale, including through our Site or our partners' platforms, you agree to be bound by these General Terms of Sale.
Definitions
Buyer
Refers to the person registered as purchaser of a lot
Catalog
Refers to the list of lots offered during an auction as well as all the information associated with them such as the description or the estimate. The catalog of each sale is available on our Site.
Purchase Commission
Refers to the commission that the buyer must pay to LLB AUCTION in the purchase price. The rate of the Purchase Commission is subject to modification at our sole discretion. The rate of the Purchase Commission currently applicable to all auctions organized by LLB AUCTION on the Site is 25% of the hammer price.
Purchase Price
Refers to the Hammer Price to which is added the Purchase Commission, all increased by the applicable VAT and/or applicable local sales tax, as well as any applicable resale right charged to the Buyer.
2. Conditions relating to Auctions organized by LLB AUCTION
Each sale organized by LLB AUCTION is subject to Luxembourg legislation, these General Terms of Sale and the general conditions of the Online Platforms on which LLB AUCTION may organize Sales.
It is specified that each sale will be expressly made for cash.
All objects presented during the Sale come from voluntary deposits and are not contested by the depositing Sellers.
3. Obligations incumbent on the Buyer
By registering and participating in a Sale organized by LLB AUCTION you agree to be bound by these General Terms of Sale. You declare and acknowledge that your bids are genuine and are not the product of collusion or any other anti-competitive agreement and that they comply with any applicable law or regulation.
The last highest bidder wins the auction and becomes the Buyer who bears the obligation to pay cash for the item on which he won the auction.
The Buyer must pay in addition to the Hammer Price, the Purchase Fees which are considered as part of the Purchase Price.
4. Payment
LLB AUCTION requires that Buyers proceed with payment of winning bids at the end of the Sale and within 10 working days:
- by bank transfer to LLB AUCTION's bank account
- in cash in euros provided that the amount is less than €15,000.00
- by Visa or Mastercard bank card
The delivery of Lots is conditional on receipt of full payment for the Lots. No Lot will be handed over to purchasers before payment of all amounts due.
5. Delivery and storage fees
Sold Lots may only be collected or sent after receipt of payment in full. Lots may be sent to Buyers at their expense and upon express request.
LLB AUCTION agrees to keep lots free of charge within 30 days from the end of the Sale. From the 31st day, storage fees of €10.00 per day per object may be charged to the Buyer.
